  1. Mr. Branca,

I would be interested in hearing your opinion on the difference between justified and excusable homicide when it comes to FL Statute 776.032. The state listed both options in the jury instructions for a reason, but the final verdict form had no checkbox to indicate whether the homicide was found to be excusable or justifiable in the not guilty verdict. The statute only refers, specifically, to justifiable homicides.

Would that determination only come at such a time as Mrs. Fulton and Mr. Martin filed wrongful death suit against Mr. Zimmerman, or is it presumed to be justifiable specifically through the Not-Guilty verdict?

    Thank you for your time.
